In general terms, disability is a mental or physical illness or injury that prevents you from working like you normally would. In order to prove you qualify for disability insurance, you will need to fill out a form about your illness.


It's possible to file an appeal after being denied your claim for disability insurance or a payout of leave benefits to take care of your family - here's how.


An appeals system is in place in most states along with a structured method of filing disability claims. Actually, the notice of disqualification sent by the state disability insurance program will also include an appeal form.


You can appeal against being disqualified for insurance within 20 days of receiving the notice in the mail. If you lose this appeal form, you can always write a detailed letter with references, saying why you shouldn't be disqualified from receiving disability insurance benefits.

Having had benefits already paid and thus being ineligible is a common reason for being disqualified for those benefits. After receiving your letter appealing a decision, the State Disability Insurance Program evaluates the facts and rational of your appeal and will notify you of their decision within a given period of time. If they cannot begin to make payments, there is another level of judgement - usually at the office of unemployment insurance appeals board's local appeals office. At this point an independent officer, who will act as a judge, will hear your reasons for appeal, as well as hear the arguments from the representative from the disability program and in turn will make a final decision on your eligibility or not for disability insurance. The judge determines what the disability law is.


While making disability insurance appeal keep the following in mind:

- Give many good reasons as to why you are making the appeal; if the forms and documents provided to you are inadequate, write a letter including all reference numbers.


- Remember to give your identifying information along with your bosses' name (this may or may not apply to you) in every instance of communications. Make sure that you clearly mention your name and affix your signature on all forms, documents and communications. Rubber stamp signatures are enough for some state departments.

- Hence, in case your physicians desire to employ one, compel them to put their signature on paper.

- You must attend all hearings and meetings relating to your appeal. In case you cannot attend, notify the relevant office well in advance and reschedule. When you call, use a reference number. Your appeal will surely be dismissed if there's a non-appearance at your hearing.
